You may be eligible to seal records of a specific arrest or criminal charge if:
- You were arrested but no charges were ever filed;
- Charges were filed but all charges were later dismissed (unless part of a plea in another case);
- You were acquitted of all charges at trial;
- You successfully completed a deferred judgment and sentence on all charges to which you pleaded guilty*;
- Your case was dismissed as part of a plea agreement in a separate case
and it has been at least 10 years since you completed any sentence in
the separate case and you have not had any further criminal convictions.
-You were convicted in a municipal court or convicted of only a petty
offense and it has been at least three years since all parts of the
sentence were completed (and you have not been charged with a felony or
misdemeanor since)
*Recent court decisions have ruled that a deferred judgment for a sexual offense, a DUI, or a DWAI cannot be sealed.
Some minor drug possession convictions as well as crimes committed
while the victim of human trafficking are now eligible to be sealed,
however eligibility for sealing under these provisions are very limited.
You should consult with an attorney if you believe you qualify under
the provisions.
Why Use an Attorney?
A petition to seal records is a civil case, meaning you are filing it
yourself, including paying filing fees, and you are expected to handle
every aspect of it yourself. If you do not properly notify every agency
that has your records, those agencies are not required to seal your
records, and any mistakes in the petition itself may cause the court to
deny the sealing altogether. You do not get your money back if you make a
mistake, and you are barred from filing another petition for a year!
